Welcome to use the products and services (hereinafter referred to as this Service) offered through CrossDriver website (hereinafter referred to as this website)!

Your use of this Service is subject to this User Agreement (hereinafter referred to as this Agreement). Thank you for reviewing this Agreement – we hope you enjoy using CrossDriver products and services.

If you have any questions about, or if you wish to send us any notices in relation to, this Agreement, please contact us by support@crossdriver.com.

By using this Service, you (hereinafter also referred to as User or Users)are agreeing to be bound by this Agreement between you and CrossDriver Limited (hereinafter referred to as we or CrossDriver). Please be sure to read and fully understand this Agreement  and other relevant agreements, policies or guidelines of this website. When you use a particular feature of this Service, there may be separate agreements, relevant business rules, etc. for that particular feature (hereinafter referred to as specific Agreements). Where there is a conflict between this Agreement and the specific Agreement, the specific Agreement shall prevail. All the foregoing agreements, policies and rules constitute an integral part of this Agreement (collectively referred to as the entire Agreement) and have the same legal effect as the main body of this Agreement.

By clicking or checking the confirmation button such as Agree or Confirm to this Agreement or Submit Payment (the actual name of the button is subject to the page display) on this website, you mean that you have fully understood and agreed to all the terms of this Agreement.

1. Acception of Terms

1.1 By clicking Agree, you confirm that you have read, understood, and accepted this Agreement and all site policies of CrossDriver. You affirm that you have the legal capacity to use our services, place orders for shopping, and bear legal responsibility for compliance with this Agreement.

1.2 This Agreement incorporates CrossDrivers Privacy Policy, Refund Policy and all existing or future service terms, rules, and supplemental agreements (collectively, Policies). These Policies form an integral part of this Agreement and carry equal legal effect. Mandatory laws or specific Agreements between parties shall prevail where applicable.

1.3 Wherever the User is, the services and products of this website may only be used as permitted by local laws. The User is solely responsible for ensuring such compliance.

1.4 We may modify this Agreement due to regulatory changes, product updates, or operational needs. Revised terms will be posted on our website. Continued use after modifications constitutes acceptance. If you disagree, please cease all use immediately.

2. Access to Services

2.1 CrossDriver provides digital products and services via the Internet.

2.2 Users shall supply your own hardware and internet access to use our services.

3. Account and Security

3.1 Registration: To access certain services, Users may need to register an account for logging in or product deliveries of this website. You are required to provide a real, legal and valid email address for registration (used for identity verification), and we will keep your registration information confidential. CrossDriver will not be responsible for product delivery failure or other liability due to reasons not attributable to CrossDriver such as incorrect email address, but will do our best to assist the User in handling to minimize the impact on the User.

3.2 Account Updates: To ensure account security, if the User's registered information such as email address changes, please promptly update changed account details. If the User fails to modify the registered account information in time due to their own reasons, resulting in account theft, personal information leakage or other rights and interests loss, CrossDriver will not be held responsible. But we will do our best to assist the User in handling it to minimize the impact on the User.

3.3 Security Obligations: We particularly remind Users to keep your accounts, passwords, product activation codes and other important information safe and to log out safely after use. All products and services purchased by Users shall only be used by the account they have applied for. Do not give, borrow, rent, transfer, sell, resell, disclose the account or activation code to others for use, or use the account registered on this website for profit-making business activities. The User is fully responsible for all activities  under the account, and all operations after logging into the system with the account will be regarded as your own actions. If, for your personal reasons, whether intentional or negligent, important information such as your account and password is controlled by others, you shall bear any adverse consequences that may result. If you discover that someone else is using your account without permission, you should immediately notify us.

3.4 Communications: Registered Users agree and voluntarily accept service and product information sent to you by CrossDriver via email. If you do not agree to receive the aforementioned information from this website, please contact us to request to stop sending or unsubscribe.

3.5 Content Standards: Users may post certain messages using this Service. Users shall ensure that the content and form of such message comply with laws, regulations, public order and good morals. Do not create, copy, view or disseminate illegal, unhealthy or reactionary information through the Internet, and do not infringe upon the legitimate rights and interests of any entity.

3.6 Termination Rights: If the User violates laws and regulations, infringes upon the legitimate rights and interests of third parties (including but not limited to intellectual property rights), violates this Agreement or Policies, CrossDriver reserves the right to deny service, restrict account use, close Users accounts, terminate or correct User infringement, clear or edit content or cancel orders, etc. to the extent permitted by applicable laws.

4. Services of this Website

4.1 Pricing & Availability: Product information (e.g., price, stock) on this website may change at any time without prior notice. We will make every effort to ensure the accuracy of the product information viewed by Users. However, due to the instability of Internet technology and changes in the market and other factors beyond reasonable commercial efforts, there may be some lag or errors in the information displayed on this website. Users are aware of and understand this situation.

4.2 Delivery: All products sold on this website are digital products such as computer software. CrossDriver will send the product activation code via email to the email address registered or filled in by the User, and will not deliver by logistics or other means. If the email is delayed or not received, please contact us for support.

4.3 No Refunds: Digitally delivered software is ineligible for no-reason refunds once activated. See our Refund Policy for details on refunds.

4.4 License Restrictions: Unless otherwise specified, the software sold on this website is one code per device. When the User receives the activation code or registration code, the activation can only be installed on one computer specified by the User. The User has the right to use the quantity of the purchased software, but it is strictly prohibited to provide the purchased software to any third party, including but not limited to leasing, lending or reselling, without the written permission of the copyright owner.

4.5 Promotions: Promotions may be carried out from time to time on this website. Unless otherwise specified, CrossDriver does not undertake to provide continuous services for the software included in the promotion (if any), including but not limited to software upgrades, software maintenance, lifetime authorization, etc.

5. License Grant

5.1 You are granted a limited, non-exclusive, non-transferable license to use the Services of this website, subject to the terms of this Agreement. The use of CrossDriver's specific web applications, software, etc. is subject to specific Agreement entered into between the User and the rights holder.

5.2 Restrictions: Users shall not copy, modify, reverse engineer, decompile, decode, decrypt, derive any source code or create derivative works of the content of the CrossDriver website and the software products sold, nor sell, distribute, redistribute or sublicense the software products sold.

6. Protection of Users Personal Information

6.1 CrossDriver will take reasonable measures to protect Users personal information. Except for the circumstances stipulated by laws and regulations, we will not disclose or reveal Users personal information to third parties without Users permission.

6.2 CrossDriver attaches great importance to the protection of personal information of minors. If you are a minor under the age of 18, you should obtain consent from your parent or legal guardian before using CrossDriver services.

7. Prohibited Conduct

You may not:

7.1 Using Services for illegal purposes or attempting to bypass or undermine any security features.

7.2 Using CrossDriver website, services and products to publish, transmit, distribute content that endangers national security, national unity, social stability, or is defamatory, pornographic, violent, disturbing to others, or any content that violates national laws,  regulations and policies.

7.3 Using CrossDriver website, services and products to publish, transmit, distribute or store content that infringes upon the legitimate rights of others such as intellectual property rights, trade secrets, portrait rights, privacy rights, etc.

7.4 Engage in any act that endangers the security of a computer network, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; Access to a public computer network or  another person's computer system without permission and delete, modify or add stored information; Without permission, attempting to probe, scan, test vulnerabilities in the software system or network of this website or  any other act that undermines network security; Attempting to interfere with, disrupt the normal operation of the software system or website of this website, intentionally spreading malicious programs or viruses, and other acts that disrupt and interfere with normal network information services; Forging TCP/IP packet names or parts of names.

7.5 Engage in any act that undermines the fairness of this website or otherwise affects the normal order of this website, such as exploiting a BUG (also known as a loophole or defect) for unfair advantages.

7.6 Engage in any commercial activities such as posting advertisements or selling goods, or engage in any illegal activities that infringe upon the interests of this website.

7.7 Engage in any other illegal acts that infringe upon the legitimate rights and interests of other individuals, companies, social groups or organizations.

8. Liability for Breach

You understand and agree that CrossDriver has the right to make independent judgments based on your specific conduct and may suspend services, delete accounts, or block content for violations. In addition, if your violation or breach of this Agreement causes damage to the rights and interests of CrossDriver or any other third party, you agree to compensate CrossDriver and third parties for damages caused by your breach which is not less than the amount of improper benefits you have obtained in respect of the violation or breach.

9. Disclaimers

9.1 Unless otherwise expressly stated in writing, this website and all information, content, materials, products (including software) and services contained in or otherwise provided to you through this website are provided AS IS without warranties of merchantability, fitness for a particular purpose, or non-infringement. 

9.2 CrossDriver shall not be held responsible for any delivery delay, non-delivery, service interruption, untimely service, service security, service termination or other losses caused to you due to the following circumstances:

(1) Incorrect, incomplete or false information such as the email address provided by the User.

(2) Force majeure. Force majeure is an objective event that cannot be foreseen, overcome or avoided and has a significant impact on one or both parties. This includes, but is not limited to, information network equipment maintenance, information network connection failure, computer, communication or other system failure, power failure, strike, riot, uprising, accident, fire, flood, storm, explosion, war, government action, changes in laws and regulations, orders of judicial administrative authorities, etc., which result in inability or delay of service.

(3) Third-party acts (e.g. computer viruses, Trojans or other malicious programs, or hacking.

(4) Problems such as device compatibility errors, network overload, server system crashes, and third-party website issues.

(5) Improper User operation.

(6) Other situations that CrossDriver cannot control or reasonably foresee.

However, we will strive to cooperate to minimize the losses and impacts caused to Users.

9.3 CrossDriver shall not be liable for any risk of information leakage, property loss, etc. resulting from your own disclosure of account passwords, activation codes, sharing of accounts with others, lending or transferring accounts to others for use.

9.4 You understand and agree that, to the extent permitted by law, CrossDriver shall not be liable for any indirect, incidental, special or consequential damages suffered by you, including but not limited to: (1) loss of production, business, income, profits, data, goodwill, opportunity or value; (2) consequential, incidental, indirect damages, even if they are foreseeable; (3) losses resulting from your own fault or cause.

9.5 Liability Cap: CrossDrivers maximum liability to the User, its affiliates or any third party shall be limited to the amount paid by the User for the affected service.

9.6 CrossDriver shall not be liable to you for any loss resulting from the acts or omissions of third parties, including but not limited to payment services, network access services, and infringement by any third party.

9.7 You understand and agree that CrossDriver will make its commercially reasonable efforts to ensure the security of your data when using the products and services on this website. However, CrossDriver cannot provide a complete guarantee in this regard, including but not limited to the following situations: (1) CrossDriver shall not be liable for any damage or loss of data related to your use of the software or services; (2) If you stop using the software and services or the services are terminated or cancelled, CrossDriver may permanently remove your data from the server. After the service is stopped, terminated or cancelled, CrossDriver is not obligated to return any data to you.

10. Governing Law and Dispute Resolution

10.1 This Agreement is governed by and construed in accordance with the laws and regulations of the Hong Kong Special Administrative Region of China.

10.2 Any dispute, controversy, difference or claim arising out of or relating to this Agreement, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The law of this arbitration clause shall be Hong Kong law. The seat of arbitration shall be Hong Kong.
